Legal & Compliance
Terms of Service
Last Updated: November 2026 · Governing Law: Queensland, Australia
1. Introduction & Acceptance
These Terms of Service (“Terms”) govern all bookings, equipment hires, and photo booth experiences provided by Stage 360 (“we”, “our”, or “us”) across Brisbane, the Gold Coast, the Sunshine Coast, and surrounding South East Queensland regions.
By booking an event, paying a deposit, signing an agreement, or utilising our digital photo booths, 360 video platforms, or roaming booth services, you (“the Client” or “Host”) agree to be legally bound by these Terms.
2. Bookings, Deposits & Payment Terms
- Booking Confirmation: A booking is formally secured only once a written quote acceptance has been submitted and the agreed non-refundable booking deposit (typically 25% to 30% of total hire fee) has cleared into our nominated account.
- Final Balance: The remaining balance of the booking fee is strictly due fourteen (14) days prior to the event date, unless explicitly agreed otherwise in writing.
- Late Bookings: For events booked within fourteen (14) days of the scheduled date, 100% of the total balance must be paid immediately upon booking.
- Additional Operational Hours: Any extension of hire time requested on-site during the event is subject to attendant availability, equipment schedule, and must be approved and paid at our agreed hourly overtime rates.
3. Cancellations, Rescheduling & Refunds
We understand that event timelines can shift. Our cancellation and rescheduling policy adheres strictly to the Australian Consumer Law (ACL):
- Client Cancellation: In the event of client cancellation more than 30 days prior to the event, the initial deposit remains non-refundable as it covers date reservation and preparatory administrative work, but any additional prepayments will be refunded in full.
- Cancellations Within 14 Days: Cancellations made within fourteen (14) days of the event date forfeit 100% of the booking fee, as equipment and trained staff have been reserved exclusively for your date.
- Rescheduling: You may request to reschedule your event to an available alternative date within six (6) months of the original booking date with at least 21 days' advance notice without penalty.
- Inclement Weather (Outdoor Events): Stage 360 requires a 100% sheltered, waterproof, dry, and wind-protected area. In the event of adverse weather, the Client is responsible for providing an adequate indoor or covered backup venue. Cancellations due to weather without a covered backup are non-refundable.
4. Venue Access, Power & Space Requirements
To ensure a seamless, professional experience, the Client agrees to ensure the following venue conditions:
- Setup Access: Our team requires access to the event venue at least 60 to 90 minutes prior to the scheduled start time for setup, sound checks, and lighting calibration. Pack-down requires approximately 45 to 60 minutes following the operational hire window.
- Space Requirements: A minimum flat, level, solid, and dry floor space of 3m x 3m (for 360 photo booth platforms) or 2.5m x 2.5m (for open-air photo booths) is required.
- Dedicated Power: One dedicated standard 240V / 10A mains power outlet located within 10 metres of the booth setup location.
- Wi-Fi / Cellular Reception: Instant on-site sharing (AirDrop, SMS, QR codes) relies on cellular data or venue Wi-Fi. In venues with low reception, all digital media is queued securely and processed immediately once network connectivity is re-established.
5. Equipment Safety, Conduct & Damage Liability
Stage 360 provides commercial-grade, tested equipment and trained on-site staff. The safety of guests and equipment is our highest priority:
- Guest Conduct: The Client is responsible for maintaining orderly conduct among event guests around the booth and revolving camera arm. Drinks, open food containers, and smoking/vaping are strictly prohibited on or immediately adjacent to the platform.
- Attendant Discretion: Our attendants reserve the right to pause or terminate booth operations immediately if behaviour poses a danger to guests, staff, or equipment. In such cases, no refund or compensation will be issued.
- Damage or Theft: The Client accepts financial liability for any damage, vandalism, loss, or theft of Stage 360 equipment caused by attendees, guests, or venue staff during the hire period.
6. Digital Media, Online Galleries & Consent
- Delivery Times: Guests receive their photos and 360 slow-motion clips instantly on-site via AirDrop, SMS, or QR code. The host is provided with a complete high-resolution digital gallery link within 24 to 48 hours following the event.
- Gallery Hosting: Event galleries remain hosted online for a minimum of ninety (90) days from the event date. We encourage clients to download and back up their media promptly.
- Promotional Use: Unless the Client requests privacy in writing prior to the event date, Stage 360 reserves the right to use select video clips or photos in our professional portfolio, social media channels, and marketing materials. We respect client confidentiality and will never publish content from strictly private or sensitive events when requested.
7. Force Majeure & Limitation of Liability
Stage 360 maintains high operational standards and backup equipment. However, in the unlikely event of total equipment failure, transport breakdown, severe weather, natural disaster, power outage beyond our control, or medical emergency:
- Our total legal and financial liability to the Client shall be strictly limited to a full refund of any fees paid for the affected hire window.
- Stage 360 shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the hire or failure of services.
8. Australian Consumer Law & Governing Law
Nothing in these Terms limits, excludes, or modifies any statutory rights or consumer guarantees granted under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law. These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia.
